TOWNSHIP OF INDEPENDENCE OF WASHINGTON, PENNSYLVANIA NOTICE OF PROPOSED ADOPTION OF CODIFICATION ORDINANCE Please take notice that a proposed Code Adoption Ordinance was introduced by the Board of Supervisors of the Township of Independence at a regular Board meeting held on August 18, 2010. A copy of the proposed Code Adoption Ordinance and the code may be examined in the office of the Township Secretary at 16 Campbell Street, Avella, PA 15312. A summary of the proposed Code Adoption Ordinance and a listing of the Table of Contents of the proposed codification are as follows: ORDINANCE NO. ____ AN ORDINANCE TO APPROVE, ADOPT AND ENACT AN ORDINANCE CODIFICATION OF A COMPLETE BODY OF LEGISLATION FOR THE TOWNSHIP OF INDEPENDENCE, COUNTY OF WASHINGTON, COMMONWEALTH OF PENNSYLVANIA; TO PROVIDE FOR THE REPEAL OF CERTAIN LEGISLATION NOT INCLUDED THEREIN; TO SAVE FROM REPEAL CERTAIN OTHER LEGISLATION NOT INCLUDED THEREIN; AND TO PROVIDE PENALTIES FOR THE VIOLATION OF THE CODE OR CHAPTERS THEREOF This proposed ordinance provides: (1) For the approval, adoption and enactment of the codification of a complete body of legislation for the Township of Independence, as revised, codified and consolidated into titles, chapters and sections, such codification being designated as the Code of the Township of Independence. (2) That the provisions of the Code are intended as the continuation of legislation in effect immediately prior to the adoption of this ordinance. (3) For the repeal of ordinances or parts of ordinances of a general and permanent nature which are not included in the Code, except as specifically saved from repeal. (4) That certain ordinances, rights and obligations be expressly saved from appeal. (5) That ordinances of a general and permanent nature adopted subsequent to preparation of the Code but prior to its adoption are deemed part of the Code. (6) For the adoption and ratification of changes and revi sions made during preparation of the Code to the previously adopted legislation included herein, and for the inclusion of certain new legislation. Such changes, revisions and new legislation include: (a) Nonsubstantive grammatical and style changes. (b) Nomenclature changes. (c) General revision of penalty previsions. (d) Removal of specific permit and license fee amounts and authority for such fees to be set by resolution of the Board of Supervisors. (e) Adoption and ratification of other substantive changes and revisions made so as to bring pro visions included in the Code into conformity with the policies and intent of the Board of Supervisors. Such changes and revisions are specifically enumerated and described in the ordinance. (7) For the interpretation of provisions. (8) That titles, headings and editors notes are insert ed for the convenience of persons using the Code and are not part of the legislation. (9) For the filing of at least one copy of the Code in the office of the Township Secretary where they shall remain for use and examination by the public. (10) For the incorporation of future additions, deletions, amendments or supplements into the Code. (11) That Code books be kept up-to-date under the supervision of the Township Secretary. (12) That notice of introduction of the ordinance and Code be published according to law, and that enactment of the ordinance, coupled with filing of a copy or copies of the Code and publication of such notice, will be deemed due and legal publica tion of all provisions of the Code. (13) For penalties for anyone convicted of altering or tampering with the Code. (14) That provisions of the Code and of the ordinance are severable. (15) That the effective date of the Code and of the ordi nance be September 15, 2010. NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS DATE of NOTICE: September 1, 2010 NAME of RESPONSIBLE ENTITY (RE): Greene County ADDRESS: Department of Economic Development 49 South Washington Street Waynesburg, PA 15370 TELEPHONE: 724-852-5300 To All Interested Agencies, Groups and Persons: On or about September 17, 2010 the County of Greene will submit a request to the Department of Community and Economic Development (DCED) for the release of funds under the Counties allocations for FY 2008 CDBG (Contract # C000036748 - $182,264) and FY 2009 (C000046534 - $18,000) to the Borough of Rices Landing for the purpose of replacing approximately 1400 of the existing sidewalk and curbing described below: The project consists of the replacement of approximately 1,400 feet of concrete sidewalk and curb along the northeast side of Main Street from the Pumpkin Run Bridge to just beyond the Greene Walking & Bike Trail parking entrance. The proposed sidewalks will be the same width as the existing sidewalks and are to be stenciled. Electrical conduit (only the conduit) for proposed street/sidewalk lighting would also be installed under Phase I, with wiring and lighting fixtures to be installed under a later phase of the project. The proposed activity is categorically excluded under HUD regulations at 24 CFR Part 58 from National Environmental Policy Act requirements. An Environmental Review Record (ERR) that documents the environmental determinations for this project is on file at Greene County, Department of Economic Development, 49 South Washington Street, Waynesburg, PA 15370 and at the Borough of Rices Landing, 137 Main Street, Rices Landing, PA 15537. PUBLIC COMMENTS Any individual, group, or agency disagreeing with this determination or wishing to comment on the project may submit written comments on the ERR to the County of Greene, Department of Economic Development, 49 South Washington Street, Waynesburg, PA 15370, attention Mr. Justin Kubicar, Fiscal Officer. All comments received by September 15, 2010 will be considered by the County of Greene prior to authorizing submission of a request for release of funds. RELEASE OF FUNDS The County of Greene certifies to DCED that Mr. Justin Kubicar, in his capacity as Fiscal Officer, Department of Economic Development, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. DCEDs approval of the certification satisfies its responsibilities under NEPA and related laws and authorities, and allows the County of Greene to use Program funds. OBJECTIONS TO RELEASE OF FUNDS DCED will accept objections to its release of funds and the County of Greenes certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not in fact executed by the Certifying Officer of the County of Greene; (b) the RE has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient has committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by DCED; or (d) another Federal Agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58), and shall be addressed to the Department of Community and Economic Development, Center for Community Building, 4th Floor, Commonwealth Keystone Building, Harrisburg, Pennsylvania 17120-0225. INVITATION FOR BIDS The Redevelopment Authority of the County of Washington will receive bids for the construction of the DUNLEVY SANITARY SEWER IMPROVEMENTS PROJECT NO. LS 08-08 until 10:00 A.M., prevailing time, on September 17, 2010, at its office, 100 West Beau Street, Suite 603, Washington, Pennsylvania 15301, at which time and place all bids will be publicly opened and read aloud. Copies of the contract documents including drawings, technical specifications, and bid forms, may be obtained at the office of Chester Engineers, 501 McKean Avenue, Charleroi, Pennsylvania (724-483-8041). A non-refundable payment of $50.00 payable to Chester Engineers is required for each set of contract documents. Each bid shall be accompanied by a bid guaranty, which shall not be less than ten percent (10%) of the total amount of the bid. The form of the guaranty shall be in accordance with the type permitted under the contract documents. Attention is called to the fact that not less than the minimum salaries and wages as set forth in the Contract Documents must be paid on this project; that the Contractor must ensure that employees and applicants for employment are not discriminated against because of their race, age, color, religion, sex, national origin, or handicap. The Redevelopment Authority of the County of Washington reserves the right to reject any or all bids or to waive any informalities in the bidding. Bids may be held by the Redevelopment Authority of the County of Washington for a period not to exceed forty-five (45) days from the date of opening of Bids for the purpose of reviewing the Bids and investigating the qualifications of Bidders, prior to awarding of the contract. In no event will the Redevelopment Authority of the County of Washington consider a contractor as eligible if he cannot initiate the work under the contract within 10 days of the contract execution and proceed to the successful completion of the work within 90 consecutive calendar days of the Notice to Proceed.
