A Missouri woman who said she accidentally shot her cousin was sentenced to five years probation in her home state after she pleaded guilty to involuntary manslaughter Dec. 16.

Stephanie Munizza, 28, was on house arrest since Nov. 13 and had been living with the victim’s parents.

“They love this young lady. It shows true love and compassion that they allowed her to live with them. They know this wasn’t a crime. It’s just a painful tragedy that unfortunately happened,” said Munizza’s attorney David Shrager.

Munizza fatally shot Joshua Poremski early Nov. 1 as he handed her what he told her was an unloaded handgun. The gun had a loaded clip, but Poremski reportedly thought the chamber was empty. According to witnesses in the criminal complaint, Poremski said to Munizza “prove it,” when she said she could defend herself with a gun, and grabbed the gun with both hands before the gun fired and Poresmki was struck in the face. The two were among a group discussing how Munizza could obtain a permit to carry a concealed weapon.

Shrager asked Judge Jeffery Manning to consider non-reporting probation, to which he said that would equate to no sentence at all. Her probation requires her to pay court costs, remain drug-free and obey all laws. Her sentence comes as part of an earlier agreement with the Allegheny County District Attorney’s Office to withdraw a felony count of third-degree murder.
